Resumen

This article examines the use of official forms for drafting statements of reasons. It presents the obligation to use such forms as a particularly interesting regulatory idea, while emphasizing that it must not replace individualized, comprehensible sentencing motivation. From the European perspective, the analysis is framed by the requirement of a fair criminal trial under article 6 of the European Convention on Human Rights, treating reasoning as a key element enabling meaningful review and informing the parties of the grounds for the decision. This article investigates the effects of form-based justification on the quality and guarantee function of court reasoning. Using a qualitative doctrinal and jurisprudential analysis, it assesses the extent to which template-structured statements of reasons substantively reflect sentencing premises, including a clear and reviewable link between factual findings, legal qualification, and normative reasoning leading to a specific penalty. It further identifies practical standards for adequate justification: derived from legal norms and developed in case law and doctrine focusing on completeness, individualization, and internal coherence enabling effective appellate review. In conclusion, the paper underscores that even when forms are used, the statement of reasons must remain sufficiently detailed and logically coherent to prevent arbitrariness and to sustain effective appellate control.
