Abstract

This introductory study examines the sufficiency of the duty to give reasons for judicial decisions as a standard of fundamental-rights-based rationality and a principle of democratic legitimacy. Although this criterion may appear straightforward, it is nonetheless fraught with difficulties. Determining when a decision is sufficiently justified, which reasons must support it, and which criteria of correctness facilitate its effective judicial review reveals significant normative, logical, epistemological, and axiological divergences that currently preclude conceiving of reason-giving as a homogeneous guarantee conducive to predictability and uniformity. Accordingly, given the need to rethink the standards of quality and rationality governing judicial reasoning, the study concludes by identifying the main challenges that current normative, social, and cultural transformations pose to the sufficiency of the justification of criminal judicial decisions.
